Bonda Terms of Use

This is an agreement between you and AMYNEBO Sp. z o.o. ("we", "Bonda"). By registering or using the Bonda app, you agree to these Terms. If you do not agree, please do not use the service. Read carefully: there are important provisions here about the safety of meetups, the limitation of our liability, and community rules.

1. Who we are and what Bonda is

Bonda is a mobile app for real-life dating and meetups. Users create local events (coffee, a walk, a movie, board games, a date, etc.), respond to others' events, chat, meet offline, and rate one another after meeting.

Bonda is a platform for connecting people. We do not organize the events ourselves, are not a party to your arrangements with other users, and do not verify the identity, background, or intentions of users (apart from the voluntary selfie verification, which is not a guarantee - see clause 8).

2. Who may use it (age 18+)

Only adults aged 18 and over may use Bonda. By registering, you represent and warrant that:

• you are at least 18 years old;
• you have the right to enter into this agreement;
• you are not prohibited from using similar services and are not listed on any sanctions lists;
• all information you provide about yourself is truthful.

If we discover that a user is under 18, we will delete the account.

3. Your account

• Provide truthful information about yourself. It is prohibited to impersonate another person or to create fake profiles.
• You are responsible for maintaining access to your account and for everything that happens under it.
• One account per person. Do not transfer your account to others.
• Notify us (support@bonda-app.com) if you notice unauthorized access.

4. Community rules (how to behave)

Bonda is built on respect. By using the service, you undertake not to:

• harass, insult, intimidate, threaten, or display aggression;
• spread hate speech or discrimination on any ground;
• post sexually explicit content, nudity, pornography;
• send unwanted sexual advances or harassment;
• post violence, calls to self-harm, shocking content;
• impersonate another person, create fake or misleading profiles;
• engage in spam, advertising, commercial solicitation, "promotion", pyramid schemes, fraud;
• solicit money, payment details, intimate photos; carry out romance fraud;
• distribute illegal content or incite illegal acts;
• sell or advertise drugs, weapons, escort services, or any illegal activity;
• violate others' rights (privacy, intellectual property, likeness);
• collect or publish others' personal data without consent;
• use Bonda for commercial purposes without our written permission.

Violation of these rules may result in the removal of content, restriction of features, suspension or deletion of the account - at our discretion.

5. Your content (UGC)

Content belongs to you. Photos, texts, messages, events, and other content you post remain yours.

So that the service can function, you grant us a non-exclusive, royalty-free, revocable license to store, display, reproduce, and technically process your content solely for the operation and provision of the Bonda service (for example, to show your photo to other users, to deliver your messages). This license terminates when you delete the content or your account - except for a reasonable time to remove it from backups and cases where the content must be retained for safety or legal compliance.

By posting content, you warrant that you have the right to do so and that the content does not violate the law or the rights of third parties.

We may, but are not obliged to, review content. We reserve the right to remove any content that violates these Terms.

6. Zero tolerance for offensive content and abuse. Moderation

We want Bonda to be a safe place. We maintain a zero-tolerance policy toward offensive, objectionable content and conduct that violates these Terms.

You have the following safety tools available:

• Report a user or a conversation (from a profile or from a chat);
• Block anyone - a blocked person will not be able to see you, message you, or interact with you.

We review reports and take action within 24 hours of receiving a report about offensive content - we remove the content and/or delete or block the account of the user who posted it. You can reach out regarding safety at support@bonda-app.com.

7. Safety during real-life meetups - required reading

Bonda connects people who meet offline, in real life. This is an important part of the service - and at the same time your area of responsibility and risk.

• We do not verify the identity, criminal background, intentions, or trustworthiness of users. The verification badge (clause 8) is not a guarantee of safety.
• You meet other people at your own discretion and risk.
• We are not a party to meetups and bear no responsibility for the conduct of users during or after a meetup, for their words, actions, or omissions - to the extent permitted by law.

Safety tips: choose public places for first meetups; tell people close to you where and with whom you are going; do not give money or personal data to strangers; trust your instincts and leave if you feel uncomfortable; report dangerous behavior to us and, if necessary, to the police.

If you are in danger, contact your local emergency services.

8. Verification

Selfie verification is voluntary. It only means that our team has visually compared the selfie with the profile photo. It does not confirm identity via documents, age, honesty, or a person's safety, and is not a guarantee. Do not rely on the verification badge as a basis for trusting someone. We may grant, refuse, or remove verification status at our own discretion.

9. Bonda+, purchases, and payments

Bonda is free for basic use. We offer (or will offer) paid features:

9.1. Bonda+ subscription

Bonda+ is a paid subscription that unlocks additional features (for example, more active events and guests, more responses per day, read receipts for messages, and other benefits, the list of which may change).

• Name: Bonda+.
• Period and price: 1 month - 19.99 PLN / 12 months - 149.99 PLN (with a 7-day free trial), as stated in the app at the time of purchase.
• Payment is charged to your Apple ID upon confirmation of the purchase.
• The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Payment for the next period is charged within 24 hours before the end of the current one.
• You can manage and cancel the subscription in your Apple ID settings (App Store), not in the app. Uninstalling the app does not, by itself, cancel the subscription.
• If there was a trial period, any unused portion is forfeited upon purchase of the subscription.

9.2. One-time purchases (consumables)

Certain one-time features (for example, super review) are one-time purchases that are "used up" when applied. They have no monetary value, cannot be exchanged for money, are not transferable between accounts, and are non-refundable after use, except as provided by law.

9.3. Payments, seller, and refunds

• All in-app purchases are processed by Apple through the App Store; Apple is the seller (merchant of record). We do not receive or store your card data.
• Refunds are handled according to the Apple App Store rules and applicable consumer protection law. Refund requests are, as a rule, submitted to Apple.
• Right of withdrawal (14 days): as a consumer in the EU, you may have the right to withdraw from a purchase of digital content within 14 days. However, by ordering digital content/a service and starting to use it immediately, you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once use begins - to the extent permitted by law.

9.4. Payment for real-life events

Bonda does not process payments for the events themselves. Who pays for coffee, tickets, or anything else during a meetup, and how, is an arrangement between users; money does not pass through the app, and we take no part in it.

9.5. Changes to prices and features

We may change the composition of paid features and prices. We will give advance notice of changes affecting an active subscription; they do not affect a period already paid for.

10. Our intellectual property

The Bonda app itself, the name, logo, design, interface texts, and program code belong to us (or our licensors) and are protected by law. These Terms grant you no rights to our trademarks or content, other than the right to use the app for its intended purpose.

11. What you may not do with the app

The following is prohibited:

• copying, decompiling, or reverse-engineering the app (except where expressly permitted by law);
• using bots, scrapers, or automated data collection;
• circumventing protections, RLS, limits, or security mechanisms;
• overloading or disrupting the operation of the service, uploading malicious code;
• using the service in violation of the law or these Terms.

12. Suspension and termination

• You can delete your account at any time in Settings. This irreversibly deletes your profile, events, chats, reviews, photos, and selfies (subject to backup retention periods and cases where data must be retained by law).
• We may restrict, suspend, or delete your account if you violate these Terms, create a risk to other users or to the service, or if required by law. Where possible, we will notify you of the reason; in the case of serious violations or safety requirements, we may act immediately.
• After termination, provisions that by their nature are meant to continue in effect (intellectual property, limitation of liability, dispute resolution) remain in force.

13. Disclaimer of warranties

The service is provided "as is" and "as available". To the extent permitted by law, we do not warrant that:

• you will meet anyone, make a connection, or achieve any particular outcome;
• the service will operate uninterrupted, without errors or delays;
• other users will behave honestly, safely, or as they claim.

This provision does not limit your rights as a consumer that cannot be limited by law.

14. Limitation of liability

To the extent permitted by applicable law:

• we are not liable for the actions, conduct, or content of other users, including during offline meetups;
• we are not liable for indirect, incidental, or consequential damages, lost profits, data, or reputation;
• our aggregate liability to you under any circumstances is limited to the amount you paid us over the last 12 months, or 50 EUR (or the equivalent), whichever is greater.

Important: nothing in these Terms excludes or limits liability that cannot be excluded by law - in particular for intent, gross negligence, harm to life or health, as well as your mandatory consumer rights under EU and Polish law.

15. Indemnification

To the extent permitted by law and without prejudice to your consumer rights, you agree to indemnify us for reasonable losses arising from your gross violation of these Terms or of the law, or of the rights of third parties as a result of your actions on Bonda.

16. Terms related to the Apple App Store

Since you download Bonda from the Apple App Store, the following provisions apply (Apple requires this):

• these Terms are concluded between you and us (the developer), and not with Apple; we, not Apple, are responsible for the app and its content;
• Apple has no obligation to provide support or maintenance for the app;
• if the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligations;
• for claims relating to the app (product liability, non-compliance with the law, consumer rights, infringement of intellectual property rights), we, not Apple, are responsible, within the limits of these Terms and the law;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you;
• you confirm that you are not located in a country subject to an embargo and are not on any prohibited-party lists, as required by Apple's rules.

17. Changes to the Terms

We may update these Terms. We will give advance notice of material changes in the app (and/or by email). Continued use of Bonda after the changes take effect constitutes agreement with the new version. If you do not agree, you may stop using the service and delete your account.

18. Governing law and dispute resolution

• These Terms are governed by the law of Poland (without regard to conflict-of-law rules) - without prejudice to the mandatory consumer protection rules of your country of residence in the EU, which apply in any event.
• First, we try to resolve a dispute amicably - write to support@bonda-app.com.
• As a consumer, you may bring a claim before the court at your place of residence. You also have access to the EU online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

19. General provisions

• If any provision is held invalid, the rest of the Terms remains in force.
• We may transfer our rights and obligations under these Terms (for example, in a business reorganization); your rights will not be affected as a result.
• These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding Bonda.

20. Language of the document

The Terms are available in Ukrainian, English, and Polish. The original was drawn up in Ukrainian; the translations are for convenience. In the event of material discrepancies, the Ukrainian version prevails, except where mandatory consumer protection rules of your country of residence require otherwise.
